Jurisprudence 'Al-fiqh' matters and choices based on the requirement of piety,(punishments, blood money, 'Nozor', and judiciary as a model)

Abstract

'Al-fiqh' as a science is one of the precious and most useful branches of knowledge.

By 'Al-fiqh' man knows 'Al-hala' from 'al-haram',and what is recommended from despised. Man knows what is intended and do, also what should he be apart from and what is avoided. In both cases, he is rewarded.

By 'Al-fiqh' man discriminates what is option and obligatory, so he is able to know when he use optionals and when sticking to obligatories.

If we consider 'Al-fiqh' matters in their books at ancient times and modern ones, we can find matters/points which were built away from basis mentioned as there is no clear evidence from 'Quran', 'sunnah' and there is no trace from 'sahaba' and their followers.

Results might be different from what is demanded. They had their condemnation on agreat base from the basis od original religion that's to say 'piousness'.

This study relied on the inductive approach in collecting, arranging and coordinating the material on this topic, in addition to the analytical approach in studying its content and extracting its components,
